Terms and Conditions for Pilates Unlimited – The Art of Movement

Welcome to Pilates Unlimited – The Art of Movement, a division of Of-CourseOnline. By accessing our facilities, classes, and services, you agree to abide by the following Terms and Conditions. Please read these terms carefully to ensure you understand and comply with them.
1. Business Details
Pilates Unlimited – The Art of Movement operates as a division of Of-CourseOnline, offering in-person and online Pilates classes. Our studio is located at:

We strive to provide a safe, welcoming environment for all clients, regardless of their fitness levels. Clients who have experienced injuries or surgeries must provide a medical clearance from their doctor or physiotherapist, as well as relevant medical documentation (e.g., x-ray reports), confirming they are fit to participate in a Pilates workout routine.
2. Booking and Payment Policies
- Booking Requirements: Clients may book classes in person, online, or through the Book-a-Mat app. We encourage early booking to secure a spot in the desired class.
- Cancellation Policy: Cancellations must be made more than 24 hours before the scheduled class time to avoid charges. Cancellations made within 24 hours of the class and no-shows will be fully charged for the missed session.
- Payment Terms: We accept card and debit orders made online or in the studio. We operate a no-cash policy. Membership and subscription fees must be paid in full by the due date to maintain access to classes and facilities.
3. Refund and Cancellation Policies
- Non-refundable Fees: Fees for services already rendered are non-refundable. However, refunds will be issued for unused credits if a client leaves the studio.
- Credits for Cancelled Classes: If Pilates Unlimited cancels a class and cannot provide a rescheduling option, we will issue a credit for future use.
4. Client Responsibilities and Assumptions of Risk
Clients acknowledge that Pilates and exercise involve inherent risks. To ensure a safe experience:
- Health Requirements: Clients must disclose any injuries, health conditions, or recent surgeries. Post-operative clients are required to provide medical clearance from a surgeon or physiotherapist before engaging in physical activity.
- Assumption of Risk and Liability Waiver: Clients must be transparent regarding their physical and mental health, as non-disclosure may increase the risk of harm or injury. Pilates Unlimited is not liable for injuries resulting from undisclosed conditions.
- Studio Conduct: Clients are expected to maintain respectful and considerate conduct at all times. Complaints should be directed to the studio administrator or receptionist via email or digital message. Clients should remove shoes when using equipment, report any discomfort or pain to the instructor immediately, and refrain from using large equipment without instructor supervision.
5. Privacy and Data Protection
In compliance with the Protection of Personal Information Act (POPIA), we prioritize the confidentiality of your personal information:
- Data Collection: Personal data related to bookings and client information will remain confidential and will not be shared with third parties outside of Pilates Unlimited and Of-CourseOnline without explicit consent from the client, except as required by law.

6. Intellectual Property
All online and in-studio content provided by Pilates Unlimited is the exclusive property of Pilates Unlimited and Of-CourseOnline. Clients agree not to copy, redistribute, or replicate any content without explicit permission. This includes, but is not limited to, course material, online content, and digital classes.
7. Limitation of Liability
- Injuries and Damages: Pilates Unlimited and Of-CourseOnline are not liable for injuries or damages sustained from unsupervised or improper use of equipment or facilities. We emphasize that clients must disclose any injuries, health conditions, or other relevant information before starting any workout regimen. Failure to communicate discomfort or pain during a session can increase the risk of injury.
- Assumption of Responsibility: Clients agree to assume full responsibility for informing instructors of any physical limitations or discomfort to prevent potential injuries. Any negligence or non-disclosure of health status by the client absolves Pilates Unlimited and Of-CourseOnline from liability.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of South Africa. By participating in our services, you consent to the jurisdiction of the South African courts.
